Technology and Commercial law

Technology has transformed the way the modern world works and communicates, generating massive benefits and possibilities. The legal and commercial implications are complex and ever-changing, impacting every organisation, as they try to keep pace.

What EY technology and commercial law can do for you

Ireland is a strategic gateway to the EU and the rest of the world, from which EY Law Ireland combines deep pools of technical and regulatory knowledge to provide innovative, commercial and responsive client solutions.

Our team of dedicated technology, contract, IP, privacy, data and data security lawyers have a wealth of experience working with domestic and international clients across sectors delivering solution-focussed advice.

We work closely with colleagues across wider EY service offerings, including EY AI Labs, data analytics, forensics and consulting, bringing practical approaches to complex and emerging areas of law.

EY’s global legal practice of over 3,500 legal professionals allows us to provide clients with multi-disciplinary insights and innovative solutions that are highly integrated with other EY service offerings, ensuring unique end-to-end legal, tax, technology, strategy and consulting services.

Core Client Service Offerings

We advise across sectors on the regulatory aspects of new technologies including Artificial Intelligence and Web3 enabling technologies, and where laws and sectors specifically meet including Healthtech and Fintech.

We help clients to identify and manage the regulatory aspects of their data ambitions, and work closely with EY colleagues to design and implement effective data governance frameworks and sources of data.  As the laws relating to data and data governance continue to evolve, we advise on the current and anticipated regulatory landscape relating to data (personal and non-personal), privacy and data security laws, including intersecting laws on Artificial Intelligence, data spaces and sharing, and sectoral rules relating to re-use of data, security and resilience.

We help clients to unlock the value of their intellectual property (IP) and customer interactions as they invest in digital assets, including NFTs.  We advise on all aspects of IP, including trade marks, passing off, copyright, patents, designs, trade secrets and database rights. We work closely with clients to design IP strategies covering the protection, development, commercialisation and management of IP and digital assets more broadly.  We provide clients with unique solutions supported by wider EY service offerings including tax, valuations, strategy and legal managed services for smart IP management and governance.

We assist clients on the contracts underpinning their technology transformation projects, whether on the buy or sell side, including the sourcing, licensing and regulatory aspects.  We draft, negotiate and advise on all types of contracts including distribution, resale and agency arrangements, together with advertising, sponsorship, commercial joint ventures and manufacturing. We identify the laws impacting business relationships and supply chain, and provide for these in individual contracts or as part of regulatory-driven contractual remediation projects. We guide clients through contract governance, supply chain and vendor management, supported by legal managed services and technology solutions.

We assist clients to identify and navigate laws applicable to their online practices and interactions, whether those interactions are on a B2C or B2B basis. We advise on all aspects of platform regulation including the Digital Services Act, Digital Markets Act and Platform to Business Regulation.

Whether Ireland-based or those seeking to expand to the Irish consumer market, we help organisations to build their customer experience in compliance with consumer laws. Various laws impact how businesses may communicate and sell to consumers, including black-listed consumer terms, and rules regarding online sales, cancellation, advertising, price display, promotional sales, product warranties, after-sales and gift vouchers. Our team has a wealth of experience advising across these issues including regulator interactions.
